Ruling no. 137/2020 of the Judicial Council of the Kozani Court of First Instance (published in Poiniki Dikaiosyni, May 2021 issue, p. 700). The decision examines the elements of forgery under the previous Criminal Code and the means of its commission, the use of a forged document, and the notions of fabrication and falsification.

It addresses the elements of felony forgery under the new Criminal Code, the sufficiency of indications of guilt, and the judges’ duty to assess all evidence of their own motion. With the repeal of Law 1608/1950, the act was found to constitute a misdemeanour rather than a felony, since the latter requires a benefit and corresponding damage exceeding 120,000 euros. The prosecution was therefore permanently discontinued due to the limitation period.
